File for FMLA Whenever Possible

The Family Medical Leave Act (FMLA) allows workers to take a maximum of 12 weeks of unpaid leave in the event of injury, illness, pregnancy or the need to care for a sick family member. The FMLA requires employers to protect the employee's position as well as provide health benefits during this time. However, an employee is only eligible for leave under the FMLA if they have worked for their current employer for 12 months, logged at least 1,250 hours over a 12 month period, and the employer has at least 50 or more employees within 75 miles.

An accident in your home or on-the-job can result in the need to take an extended leave from your place of employment. If you do not file for FMLA leave, your employer does not have to protect your job. As such, you will not have any legal recourse if you are terminated. In these turbulent economic times, be certain to take the appropriate steps to protect your livelihood.
